Believe it or not, it was only 5 years ago that same-sex couples were even allowed to get married.
Since then, sure, we’ve come a long way, but one major issue has remained; you could still be fired for your sexual orientation or the gender you identify with.
And people were being fired for being themselves. Gender identity and sexual orientation have not been considered a protected class.
That is, up until now.
Today, the Supreme Court ruled that discriminating against someone based upon their sex now directly applies to LGBTQ employees.
“Today, we must decide whether an employer can fire someone simply for being homosexual or transgender. The answer is clear,” Justice Neil Gorsuch said.
“The only question before us is whether an employer who fires someone for being homosexual or transgender has discharged or otherwise discriminated against that individual ‘because of such individual’s sex’.”
“An employer who fires an individual for being homosexual or transgender fires that person for traits or actions it would not have questioned in members of a different sex.”
“Sex plays a necessary and undisguisable role in the decision, exactly what Title VII forbids.”
So what does this all mean?
Title VII is part of the Civil Rights Act of 1964. It forbids an employer from discriminating against an employee because of their color, gender, race, sex, religion, or national origin.
And it’s about time.
I know 2020 has been nothing but a dumpster fire so far, but this is definitely one amazing thing to come of this year.
Even though it’s now illegal to discriminate against someone for their gender identity and sexual orientation within the workplace, there are still some things that need to be addressed.
The Equality Act is one bill that would make more changes to the Civil Rights Act. It would essentially prohibit discrimination due to gender identity or sexual orientation in the areas of public education, public housing, the jury system, credit, public accommodations, and federal funding.
