Her Mother-In-Law Hasn’t Paid Rent On Time Ever Since Moving Into Her Spare Apartment, So She Wants To Just Evict Her Mother-In-Law And Rent It Out To Someone Else Against Her Husband’s Wishes

This past April, this woman and her husband became the owners of a duplex.
The mortgage is only in her name, and she paid the down payment, as well as the costs related to the inspection and closing.
She and her husband, whom she has been married to for two years, live in one of the units, and her mother-in-law lives in the other.
Before her husband’s mother moved in, her husband assured her that his mother would be a responsible and reliable tenant for them.
Up until this point, she had always gotten along with her mother-in-law and thought it would be fantastic to have a family member living in the same building.
Her husband’s mother went forward with signing the lease, and she moved in last spring.
“Since she’s moved in, she has not sent her rent on time and would send random installments. First, they were large (to cover a couple of months), and then got smaller,” she said.
This month, her mother-in-law is late in paying her rent, and she owes nearly $1,000.
Not long ago, her husband’s mother got a new job, but she hasn’t started working yet.

Once, her mother-in-law suggested the idea of providing her rent by cleaning her and her husband’s apartment instead of paying her money.
Understandably, she was stunned by this.
“She also mentioned to my husband that it’s not a big deal that she’s late on rent. I recently found out she’s been jobless the whole time she’s been living here, and my husband claimed he didn’t know about that. I did create a ‘Letter to Comply’ and told my husband to give it to her. He has not,” she explained.
Now that it’s almost the end of the month, she’s sick of her mother-in-law’s behavior.
She is bothered by essentially everything her mother-in-law does, and she currently does her best to avoid her at all costs.
The issues with her mother-in-law living in their second apartment have been causing problems between her and her husband.
She’s upset that her husband assured her that his mother would make a fantastic tenant, and he doesn’t seem at all frustrated with his mother’s actions.
Not long ago, she had to start making student loan payments again, and she has other career-related expenses she’s worried about being able to afford.
Plus, she is responsible for maintaining the building and renovating it as needed.
“I feel a bit stretched thin financially, so the idea of renting my current “office”/extra room has been appealing, especially since one of our bathrooms can be a private bathroom for a tenant, but my husband refuses,” she shared.
When she suggested this idea to her husband, he objected because he wanted to have privacy and the ability to waltz around without clothes on. He wants to feel like he has enough space for himself.
Her husband earns less than she does, and he puts everything he makes into their shared savings account.
Due to all the emotional and financial anxiety, she’s debating on evicting her mother-in-law so that she can rent out that apartment to someone else, as well as rent out the spare room in her and her husband’s apartment.
What advice would you give her?
